1. Our Services

4leggedIT provides technology consulting and support to animal rescue organizations and other nonprofit organizations. Services may include website development, website maintenance, content organization, domain and DNS configuration, email setup, hosting assistance, software configuration, workflow improvements, integrations, automation, technical consulting, training, documentation, and related technology services.

Many of our services are provided free of charge or at reduced cost as part of our mission to support animal welfare organizations. Any fees, donations, reimbursements, or special arrangements will be communicated separately.

Providing free or discounted services does not create an obligation for ongoing support, maintenance, future enhancements, emergency assistance, or continued availability unless explicitly agreed to in writing.

We may modify, suspend, refuse, or discontinue any service at any time, with or without notice, including for capacity limitations, mission misalignment, or other operational reasons.

Whenever practical, third-party accounts (including domains, DNS, hosting, cloud services, email providers, website builders, and software platforms) are created under your organization's ownership and control. We may be granted administrative access solely for the purpose of performing requested work.

You are solely responsible for maintaining ownership, access credentials, billing information, renewals, and security of those accounts after delivery.

4leggedIT is not responsible for recurring costs including, but not limited to:

• Domain renewals
• Website hosting
• Email services
• Cloud services
• Software subscriptions
• Premium plugins
• API fees
• Licensing fees
• Third-party service charges

Our guidance is technical in nature and does not constitute legal, accounting, tax, fundraising compliance, or professional advice. You remain solely responsible for ensuring your organization complies with all applicable laws and regulations.

We may publicly list certain organizations on our website under sections such as "Organizations We Support." These listings simply indicate that we have provided technology support or visibility. Listing an organization does not mean we endorse, approve, or take responsibility for its operations, decisions, animal care, fundraising, policies, or any other activities. Each organization remains fully independent and solely responsible for its own work.

2. Your Responsibilities

You agree that:

• You own, or have permission to use, all content you provide.
• All information provided to us is accurate to the best of your knowledge.
• You are responsible for maintaining backups of your own data, documents, images, websites, databases, and digital assets.
• You will review all work before publishing or distributing it.
• You will use our services only for lawful purposes.
• You are responsible for maintaining administrative access to your third-party accounts.
• You are responsible for complying with all applicable laws, nonprofit regulations, fundraising requirements, and privacy obligations applicable to your organization.

3. Intellectual Property

You retain ownership of:

• Your organization's name
• Logos
• Trademarks
• Images
• Website content
• Documents
• Adoption forms
• Rescue information
• Other materials you provide

Unless otherwise agreed in writing, 4leggedIT retains ownership of:

• Software
• Source code
• Templates
• Components
• Workflows
• Documentation
• Libraries
• Automation
• Scripts
• Design systems
• Processes
• Reusable materials developed independently or used across multiple organizations

For deliverables created specifically for your organization (for example, a custom website or unique workflow), you are granted a perpetual, non-exclusive, royalty-free, worldwide license to use, modify, and maintain those deliverables solely for your organization's internal purposes. 4leggedIT retains the right to reuse generalized components, templates, techniques, and know-how in other projects.

Open-source software incorporated into a project remains subject to its respective license.

Any AI-generated or AI-assisted content remains subject to the same ownership and license rules above. You are responsible for reviewing and approving all such content before use or publication.

4. Accuracy, Warranties & Disclaimer

Our services are provided "AS IS" and "AS AVAILABLE."

While we strive to provide accurate, useful, and reliable guidance, we make no warranties or guarantees regarding:

• Accuracy
• Completeness
• Reliability
• Availability
• Performance
• Security
• Compatibility
• Fitness for a particular purpose

Technology changes frequently. Third-party services, APIs, hosting providers, search engines, and software vendors may change their products without notice.

We do not guarantee:

• Website uptime
• Search engine rankings
• Grant eligibility
• Donation increases
• Adoption outcomes
• Volunteer recruitment
• Accessibility compliance
• Regulatory compliance
• Compatibility with future software updates
• Continuous availability of any third-party service

Some recommendations or content may be generated or assisted by artificial intelligence. AI-generated content should always be reviewed by your organization before publication or use.

5. Limitation of Liability

To the fullest extent permitted by law, 4leggedIT, its volunteers, contributors, officers, directors, contractors, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to:

• Use of our services
• Website downtime
• Data loss
• Lost donations
• Lost revenue
• Lost opportunities
• Business interruption
• Security incidents
• Third-party service failures
• Advice or recommendations provided

Our total liability for any claim shall never exceed the amount paid to 4leggedIT for the specific services giving rise to the claim.

If the services were provided at no cost, our maximum liability shall be zero dollars ($0).

Nothing in these Terms limits liability where prohibited by applicable law.

6. Third-Party Services

Our work frequently involves third-party services, including website hosts, domain registrars, email providers, cloud platforms, pet registries, AI providers, analytics platforms, payment providers, and form providers.

These services operate independently.

We do not control and are not responsible for their:

• Security

• Pricing
• Terms of service
• Service interruptions
• Product changes
• Data handling

Your use of those services is governed by their own policies.

7. Indemnification

You agree to defend, indemnify, and hold harmless 4leggedIT and its volunteers, contributors, directors, officers, affiliates, contractors, and representatives from any claims, damages, liabilities, losses, costs, or legal expenses arising from:

• Content you provide
• Your use of our services
• Your violation of these Terms
• Violation of another person's intellectual property rights
• Your organization's activities or operations

This indemnification obligation shall survive termination of these Terms or the end of any services.

8. Conduct

You agree not to:

• Misrepresent your relationship with 4leggedIT.
• Use our name, logo, or branding without permission.
• Use our services for unlawful purposes.
• Harass, threaten, or abuse volunteers or contributors.
• Attempt to gain unauthorized access to our systems.

We reserve the right to refuse or discontinue services for any reason, including abusive conduct, unlawful activity, conflicts of interest, misuse of our services, actions inconsistent with our mission, capacity limitations, or other operational reasons.

9. Termination

Either party may discontinue services at any time.

Upon termination:

• Your content remains yours.
• Third-party accounts remain your responsibility.
• Outstanding fees owed to third-party providers remain your responsibility.
• Certain provisions of these Terms—including intellectual property, indemnification, limitation of liability, governing law, and dispute resolution—will continue to apply.

10. Force Majeure

4leggedIT shall not be liable for delays or failures caused by events beyond our reasonable control, including natural disasters, internet outages, cyberattacks, utility failures, labor disputes, acts of government, pandemics, or failures of third-party providers.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Riverside County, California.

Before filing a lawsuit, both parties agree to make a good-faith effort to resolve the dispute through informal discussion or mediation.

12. Miscellaneous

We may update these Terms from time to time. Continued use of our services constitutes acceptance of the updated Terms.

Failure to enforce any provision shall not constitute a waiver.

If any provision is found unenforceable, the remaining provisions shall remain in effect.

Nothing in these Terms creates a partnership, joint venture, employment, agency, or fiduciary relationship.

These Terms constitute the entire agreement regarding use of our services.
